In using this website you are deemed to have read and agreed to the following Terms and Conditions.
The following terminology applies to these Terms and Conditions: “User”, "You", "Your" and “They” refers to you, the person accessing this website and accepting the Company's terms and conditions. "The Company", "Ourselves", "We" and "Us", refers to our Company. "Party", "Parties", or "Us", refers to both the Client and ourselves, or either the Client or ourselves. Any use of the above terminolgoy or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore referring to same.
These Terms and Conditions constitute an Agreement (hereinafter called "Agreement") between the company: The Press Office, a division of Planet Platform Trading cc, and you, the user.
Services
The Company reserves the right to deny our service to any company, entity or person.
Press releases
Once a press release has been published, no refunds are available.
If a press release is rejected:
- a refund will be issued for the payment amount made by credit card,
- a voucher will be issued for the payment amount made by bank deposit / EFT
- a voucher will be re-issued for the payment amount made by voucher.
Press release writing service
No refund is available.
Submission and Publication of Press Releases
- The press release content must be written in a press release format.
- The Company will not accept any press releases that contain references to pornographic material, illegal activities, hate speech, violence, terrorism or anything the Company deems a reasonable person would find unethical or immoral.
- Content that reads in the form of an advertisement, will not be accepted for publication.
- The press release must report on a current or recently occurred event. Press releases that are purely informational in style will not be accepted for publication.
- Full and correct company and contact details, including a physical address, are a requirement for the submission and publication of a press release. These details may not be the name of an agency acting on behalf of the User.
- The Company makes every reasonable attempt to disseminate a press release promptly and accurately. Any inadvertent errors made by the Company during the dissemination of the press release, will be corrected upon notification, at no additional charge. This obligation to correct the error constitutes the sole liability of the Company.
- The User is responsible for the content and accuracy of all information submitted by the User. The Company cannot verify any facts therein, nor will the Company be responsible for the verification and accuracy of facts contained therein.
- The User acknowledges that after their press release has been published, the User may not be able to retract, change, delete or alter information in their press release that has been distributed to the Company or the Company's wire service. The Company will make reasonable efforts to change the information in a press release that is stored on the Company servers. The User agrees that a fee will be charged per hour, or part thereof, for any changes made. The User further agrees that any unpaid or outstanding fees may result in the termination of their press release and/or suspension of their User profile on the Company website.
- The User warrants that they have the right to deliver all information and press releases submitted to the Company.
- The User warrants that they have full written permission from any companies or persons' names mentioned in their press release, other than their own.
- The User warrants that they will comply with all applicable laws, rules and regulations applicable to South Africa.
- The User will not submit any information and press releases containing content that is libellous, slanderous, obscene, defamatory, false or misleading or which violates any copyright, right of privacy or publicity or other right of any person.
- The User shall indemnify and hold harmless the Company and owners, third party vendors, including distributors, from and against any and all claims, liabilities, damages, losses, costs and expenses (including reasonable attorney's fees) arising out of or relating to any breach by the Company of the foregoing representations and warranties or otherwise arising out of or relating to the contents or nature of copy and other information provided by User or anyone acting on User behalf.
- The Company reserves the right to deny publication of a press release, edit copy or other information, as it sees necessary.
- The Company reserves the right to delete any press release from its website, without notification to the User.
- The Company does not warrant or guarantee specific placement of any press release or the use of any press release by media through its wire or service. The Company will make the press release available on the website and to the appropriate media, limited to the type of press release purchased.
Exclusions and Limitations
The information on this website is provided on an "as is" basis. To the fullest extent permitted by law, this Company:
The Company does not warrant that the services provided by the Company will be error free, including delays, interruption in service, omissions, losses or defects.
The Company excludes all representations and warranties relating to this website, its contents and its services or which is or may be provided by any affiliates or any other third party, including in relation to any inaccuracies or omissions in this website and/or the Company's literature; and
The Company excludes all liability for damages arising out of or in connection with your use of this website. This includes, without limitation, direct loss, loss of business or profits (whether or not the loss of such profits was foreseeable, arose in the normal course of business, or you have advised this Company of the possibility of such potential loss), damage caused to your computer, computer software, systems and programs and the data thereon or any other direct or indirect, consequential and incidental damages.
The liability of the Company to the User shall be limited to the refund of the amount paid by the User for a service or product, in the event the Company fails to provide the services paid for
The above exclusions and limitations apply only to the extent permitted by law. None of your statutory rights as a consumer are affected.
Communications
The User consents to receive communication from the Company. Furthermore, the User consents to receive Communications electronically. The User consents to receive communication for as long as the User is listed in the company and / or contact details of the User profile.
Copyright & Intellectual Property
Nothing within any of the Products and Services shall be construed conferring any license under the Company or any third party intellectual property rights, whether by implication, waiver, estoppels or otherwise. Without limiting the generality of the foregoing, the User acknowledges and agrees that certain content available through and used to operate the Company website is protected by copyright, trademark, patent or other proprietary rights of the Company and its affiliates, and service providers. Unless expressly provided to the contrary, the User is in agreement that the User may not modify, deface, alter any of the trademarks, service marks or other intellectual property made available by the Company in connection with the Products and Services. Furthermore, the User also agrees not to display themselves, or their website as being affiliated with, endorsed by or sponsored by the Company in any way. The User agrees not to use any of the service marks, trademarks logos or other content accessible through the the website for any purpose other than the purpose for which the content is made available. Information, services, methods, processes and content made available to the User are the intellectual property of the Company. The User also agrees to use the Company website only for its intended purpose.
Changes to these Terms and Conditions
Please note that these Terms and Conditions may change from time to time. Please check this page frequently for any changes to the Terms and Conditions. When any changes are made, we will issue an announcement through our Wordpress Blog and will highlight the changes made. Your continued use of this website constitutes your acceptance of these Terms and Conditions.

Conclusion
The User acknowledges and agrees that the User and the Company are independent contractors under these Terms and Conditions, and nothing herein shall be construed to create a partnership, joint venture, agency, or employment relationship. Neither party pursuant to these Terms and Conditions has authority to enter into agreements of any kind on behalf of the other and neither party shall be considered the agent of the other.
Should the Terms and Conditions be violated by the User, or if the User violates any other rights of the Company, the Company reserves the right to pursue any and all legal and equitable remedies against you, including, without limitation, terminating any and all user profiles on the Company websites. |
